MAPA, J.:

In November, 1900, the defendants in this case were the sole members of a mercantile partnership entitled "Nicasio & Gaspar." Wishing to purchase six vessels, the total value of which was 46,500 pesos, and not having available more than 18,500 peso for that purpose, the said defendants, in behalf of the said partnership borrowed the following amounts: 6,000 pesos from Lino Eguia; 3,000 pesos from Rafael Monserrat; 5,500 peso fro Isidoro Iboleon; 5,500 pesos from Patricio Hermoso, and 8,500 pesos from the plaintiff, Pastor. The sum total of these amounts is 28,000 pesos.
