The action which gave rise to this certiorari proceeding involves the ownership and possession of a riceland containing an area of 2 hectares, 76 ares, and 2 centares situated in Libon, Albay, which Epifanio Mata claims to have purchased from Julian Ponce. Jose Saminiada, the defendant in the action, alleged that he occupied it by virtue of free patent application No. 56140, entry No. 35499.
