There is no serious dispute as to the basic facts in this case, at least not as regards those for purposes of this decision. Before the last (Pacific) war the defendant corporation Philippine & Eastern Trading Co., Inc., as lessee was occupying two doors with mezzanine of what is known as the Lopez building in the City of Baguio, belonging to the plaintiff corporation Lopez Inc. of which Atty. Eugenio Lopez was then the President. Defendant was paying P160 monthly rental and the lease was from month to month. Said two doors were used as a store.
