CONCEPCION, J.: 

In his amended complaint, herein plaintiff, Carlos Moran Sison, seeks to recover P50,000 by way of damages, and P5,000.00 as attorney's fees, in addition to costs. Defendant Gonzalo D. David answered admitting some allegations of the amended complaint, denying other allegations thereof, alleging some special and affirmative defenses, and setting up a counterclaim. In due course, on December 10, 1954, the Court of First Instance of Manila gave judgment for the plaintiff in the sums of P5,000, as moral damages, and P1,000 as attorney's fees, besides the costs.
