The plaintiff brought this action in the Court of First Instance of the Province of Cebu for the purpose of condemning certain tracts of land in the city of Cebu which it desired to use for the purposes of its railway. The law authorizing the proceeding is found in the Code of Civil Procedure, sections 241 and following, and Acts Nos. 665, 1258, and 1592. The complaint was filed on the 21st of January, 1907. Among those who appeared and answered was the appellant, Colin Campbell.
