The basic legal question that has to be resolved in this appeal by the Republic of the Philippines from a lower court decision is whether or not the constitutional right against being twice put in jeopardy 1 may be relied upon, it being shown that defendants had been proceeded against in a previous case, which was provisionally dismissed.
