Petitioner Antonio J. Villegas, in this appeal from a decision of the lower court dismissing a special civil action for prohibition, quo warranto and mandamus, would lay claim as the Mayor of the City of Manila to the power of appointment of the Assistant City Treasurer to which office the other petitioner, Manuel D. Lapid, was by him named even if under its Charter 1 such a prerogative is expressly vested in the President of the Philippines. 2 He would invoke a provision in the Decentralization Act to the effect that all "other employees, except teachers, paid out of provincial, city or municipal general...
