The principal point stressed in this appeal from a judgment of conviction for the crime of rape is the alleged partiality of the lower court resulting in its "giving vent to its bias and prejudices against appellant by making findings of facts not established by the evidence." 1 Implicit in such an approach is the reminder that one can only be constitutionally deprived of liberty if the requirements of due process were satisfied. 2 It could very well be that he would thus stake his claim to an acquittal precisely because of the realization that one cannot be unduly optimistic if he were to rely on the other...
