MAKALINTAL, J.: 
 
I concur in the resolution penned by Mr. Justice Julio Villamor denying reconsideration of the resolution of this Court dated October 4, 1971. 
 
However, I am constrained to write this concurrence in view of certain assumptions in the dissenting opinion penned by Mr. Justice Claudio Teehankee, which to my mind not only begs the very question at issue by asserting as a categorical fact that "it reverses and sets aside the damage award therein against Ayala in favor of Tolentino (estimated at close to P2 million now)," the existence of such award being...
