The fundamental assumption in this appeal by the People of the Philippines from an order of the lower court dismissing three informations 1 against defendants, now appellees, 2 for an alleged violation of Section 3602 in connection with Section 3604 of the Tariff and Customs Code of the Philippines, 3 is its failure to respect the power of the state to determine who should conduct the prosecution of offenses and how it is to be commenced, without raising a due process question in the absence of unfairness.
