It must have been well-founded doubts about the strength of the original position taken by petitioners both in the Court of First Instance of Rizal and subsequently in respondent Court of Appeals, that in this appeal by certiorari from the decision of the latter tribunal, a novel aspect is sought to be introduced by them. It represents a last-ditch effort in their thus far hopeless quest for excluding private respondents, nephews and nieces of the late Juan Evangelista, from any share in that portion of his estate sold by his widow, petitioner Ana Gonzaga, to the other petitioners.
