There is nothing unique to distinguish this appeal from a number of others where conviction for the crime of rape is sought to set aside. A careful scrutiny of the records of the case discloses that the unfortunate victim was suddenly pounced upon by appellant, Domiciano Baylon, and notwithstanding her resistance was, by virtue of his superior strength and the intimidation caused a knife pointed at her chest, made to submit to his carnal desires.
