AQUINO, J:

This is a murder case. The testimonies of the two prosecution eyewitnesses disclose that at around six o'clock in the morning of June 9, 1968 Ricardo Cortez left his nipa hut located at Sitio Adlas, Barrio Biluso, Silang, Cavite to gather tuba from a coconut tree nearby. Flora Sarno, his wife, was left inside the hut. While he was on top of the tree gathering tuba, he was struck by a volley of shots. He fell to the ground at the base of the coconut tree.
