FERNANDO, J:

As a result of a fatal stabbing incident, Ernesto de la Victoria was prosecuted for and convicted of the crime of murder, with reclusion perpetua as the penalty, the victim being one Monico de Guzman, who in his lifetime was himself accused of the killing of a certain Perfecto Atay. There was bad blood between the de Guzman and Atay families as a sister of the former was allegedly raped by a son of the latter, whose attention as a suitor apparently was not too welcome.
