The difficulty that faces appellant Rodrigo Cawili, prosecuted and convicted for the crime of rape in the lower court, arises from the coherent and straight-forward story narrated by the offended party, a thirteen-year old girl, who, while asleep in her house was taken by surprise by the accused and thus fell victim to his carnal desires.
