FERNANDO, J:

This prosecution for rape is another instance where the opportunity for an alleged offender to abuse a married woman arose from the fact that the husband's occupation required that he be away from home at nighttime. In fairness to one charged with such a crime however, it cannot be denied that a wife none too scrupulous about fidelity to marital ties could likewise, because of such circumstance, be in a position to satisfy adulterous inclinations.
