Atty. Homobono A. Adaza in his "motion to lift the writ of preliminary mandatory injunction" in this case recklessly and sweepingly contended that its issuance "has no legal nor factual basis" and was "unjust and constitutes a serious miscarriage of justice."

To determine whether in employing such vicious, abusive and disrespectful language, he committed direct contempt of court or contempt in facie curiae, it is necessary to summarize briefly the allegations of the verified petition consisting of 209 pages.
