BARREDO, J., concurring:

I join the majority of my brethren in voting that the Judiciary Reorganization Act of 1980, Batas Pambansa Blg. 129, is not unconstitutional as a whole nor in any of its part. 

The issue of unconstitutionality raised by petitioners relates particularly to Section 44 of the Act which reads as follows: 

"SEC. 44. Transitory provisions. - The provisions of this Act shall be immediately carried out in accordance with an Executive Order to be issued by the President. The Court of Appeals, the Courts of First Instance, the Circuit Criminal Courts, the Juvenile and Domestic Relations Courts,...
