Undoubtedly, no more crucial and transcendental issue of such magnitude has confronted the Philippine judiciary than in the present case. The challenged Act, Batas Pambansa Blg. 129 by its title would reorganize all existing courts (except the nine-member Sandiganbayan 1 and the three-member Court of Tax Appeals) and upon declaration by the President of the completion of the reorganization would unprecedentedly deem all the said courts "automatically abolished" en masse and "the incumbents thereof shall cease to hold office." 2 The total abolition involves a total of 1,663 judicial positions with 1,180 incumbent...
