Before the Court en banc is a motion to reconsider the decision promulgated on July 20, 1982 which set aside the decision of respondent National Labor Relations Commission and reinstated the decision of the National Seamen Board.

To better understand the issues raised in the motion for reconsideration, we reiterate the background facts of the case, taken from the decision of the National Labor Relations Commission:
