FERNANDO, C.J.:

There is no dispute in this prosecution and later conviction for rape of appellant Leonardo Bania as to the fact of sexual intercourse having taken place between him and complainant Priscilla Aringo, a married woman. It was her version, however, as to such act having been attended by force and intimidation, that was believed by the lower court. Hence his being adjudged guilty and sentenced to suffer the penalty of reclusion perpetua, to indemnify the family of complainant in the sum of P20,000.00, and to pay the costs.
