CRUZ, J.:

The petitioner asks us to reverse a decision of the respondent court affirming that of the trial court holding the Assurance Fund subsidiarily liable for damages sustained by the private respondents under the following established facts.

Sometime in 1965, a person identifying himself as Lawaan Lopez offered to sell to the private respondents a parcel of land located in Quezon City and consisting of 1,316.8 square meters, which he claimed as his property.
