I concur in toto with the judgment of the Court (a) holding that the 1-1/2 page, single-spaced, decision of the trial court presided by Judge Oscar Leviste, sentencing the accused at bar to the supreme penalty of death without specification of the evidence, testimonial and documentary, upon which his conclusions finding them guilty had been based falls short of the constitutional requirement that every decision of a court of justice clearly and distinctly state the facts and the law on which it is based; (b) acquitting the accused Juan Escober of the crime of robbery with homicide on the ground...
