CRUZ, J.:

The basic issue raised in this petition is the validity of the order of the respondent court dismissing the petitioner's appeal for failure to file the appellant's brief on time.

The petitioner had been convicted of qualified theft in the Court of First Instance of Quezon City ** on February 26, 1968. 1 He seasonably elevated his conviction to the Court of Appeals which in due time sent him notices to file his brief, thus:
