GUTIERREZ, JR., J.:

These cases were originally before us on automatic review arising from the imposition of the death penalty by the trial court. However, subsequent to the commutation of death as a penalty to reclusion perpetua pursuant to the 1987
Constitution, the accused manifested his desire to continue the cases as appealed cases.

Accused-appellant Virgilio Uribe was charged with the crimes of murder and illegal possession of firearm in two separate informations filed with the then Court of First Instance of Leyte. For the crime of murder, the information reads:
