GUTIERREZ, JR., J., dissenting:

In dissenting from the majority opinion, I draw certain conclusions from the records which feel should guide any adjudication of the issues in these petitions.

My first conclusion refers to the denial of basic rights of an indispensably essential segment of our society - the teachers who educate our children.

The second refers to the cold hearted punishment which we allow to be inflicted upon our poor school teachers. By skirting the fundamental issue involved, the Court is denying the petitioners fairness, substantive due process, and simple humanity. The so-called investigation which led to...
