MORELAND, J.:

This is an appeal from a judgment of the Court of First Instance of Ambos Camarines convicting the appellant of the crime of causing death by gross or reckless negligence in that he, on or about the 29th day of November, 1914, discharged an airgun, loaded with a shot, against the person of Isabel Dalmita, causing a wound in the left breast from which death resulted in about 9 days.
From the evidence in the case it appears that, on the 29th of November, 1914, one Candido Sabit, being the owner and in possession of a rifle operated by compressed air, placed it in a corner of a room in a house owned by Quirico...
