The plaintiff claims to have appropriated and to own the exclusive right to use the word "Isabela" on cigarettes.

Something before the commencement of this action defendant began the manufacture of cigarettes, offering them to the public in packages on the front side of each of which appeared the words "Alhambra Isabelas." This action was brought to enjoin the defendant from so using the word "Isabelas." Judgment was for plaintiff and defendant appealed.
