BELLOSILLO, J.:

On the belief that the case for the prosecution depends in the main on his own extrajudicial confession which he claims is inadmissible, accused Marlo Compil y Litaban filed a demurrer to evidence instead of presenting evidence in his behalf. The trial court however denied his demurrer, admitted his extrajudicial confession, and found him guilty of robbery with homicide. Now, before us, he maintains that his extrajudicial confession was extracted without the assistance of counsel, thus constitutionally flawed.
