This petition filed under Rule 65, of Court, assails the decision 1 of public respondent National Labor Relations Commission (NLRC) upholding the labor arbiter's ruling 2 which declared private respondent Agapito T. Tolentino's transfer and demotion as an illegal constructive dismissal.

The evidence shows that private respondent had been employed by petitioner Jarcia Machine Shop & Auto Supply Inc. (hereinafter, Jarcia) as machinist for sixteen (16) years beginning 1976. 3
