Petitioner questions the award of separation pay to respondent workers after their employment was terminated when the company ceased operations.

Petitioner Megascope General Services is a sole proprietorship engaged in contracting out general services. In 1977, it entered into a landscaping contract with the System and Structures, Inc. (SSI) which subcontracted the construction of the National Power Corporation Housing Village in Bagac, Bataan. In hiring laborers, petitioner would give them work from five (5) to ten (10) days as the need arose and there were periodical gaps in the hiring of employees. 1
