Here is yet another instance where the Court, aware as it is of the persistent calls of the public for the conviction of society's misfits, finds itself constrained to apply the maxim "Better to free a guilty man than to punish the innocent." In a recent decision, the Court aptly stated: "It is better to liberate a guilty man than to unjustly keep in prison one whose guilt has not been proved by the required quantum of evidence." 1 Hence, despite the Court's support to ardent crusaders waging all out war against felons on the loose, when the People's evidence fail to indubitably prove the accused's authorship...
