PARDO, J.:

The case before the Court is an appeal via certiorari from a decision of the Court of Appeals1 [In CA-G.R. No. 16607, promulgated on January 31, 1996.] affirming, with modification as to the penalty, that of the Regional Trial Court, Pasig, Metro Manila,2 [In Crim. Case No. 92745.] convicting petitioner of frustrated homicide. He claimed self-defense.

We sustain the appeal. Petitioner acted in legitimate self-defense. We acquit him of the charge of frustrated homicide.
