D E C I S I O N

PER CURIAM:

When an accused appeals from the judgment of the trial court, he waives the constitutional safeguard against double jeopardy and throws the whole case open for review of the appellate court, which is then called to render such judgment as law and justice dictate, whether favorable or unfavorable.[1] With this precept in mind, this Court as the ultimate dispenser of justice, will not hesitate to render the proper imposable penalty, whenever it sees fit, even the supreme penalty of death.
