This is an appeal from the decision1 [Per Judge Jose G. Abdallah.] dated October 7, 1994 of the Regional Trial Court, Branch 39, Iloilo City, finding accused-appellant Edgar Macarse guilty of Highway Robbery with Homicide under Presidential Decree No. 5322 [Anti-Piracy and Anti-Highway Robbery Law of 1974.] and sentencing him to reclusion perpetua.3 [Under P.D. No. 532, the imposable penalty is death. However, as the offense was committed on August 10, 1990, prior to the reimposition of the death penalty on December 31, 1993 under R.A.
