QUISUMBING, J.:

On appeal is the decision[1] of the Regional Trial Court of Quezon City, Branch 78, in Criminal Case No. Q-95-61405, convicting appellant Julio Herida y Bernabe, alias "Jun Tagay," of murder and sentencing him to suffer the penalty of reclusion perpetua.

In an Information dated May 16, 1995, Julio Herida and Nonito Jamila, Jr., were charged by the City Prosecutor of Quezon City with murder, allegedly committed as follows:
