JOHNSON, J.:

The defendant was accused of the crime of embezzlement in the language following:

"That the said J. Valentin Karelsen, on the 2nd day of April, 1903, whilst acting as postmaster at Calamba, of the Province of Laguna, P. I., and having in his charge public funds belonging to the post-office, withdrew, for his, own use and benefit, the sum of $1,000, gold currency of the United States, the property of the Post-Office Department of the Government of the Philippine Islands, contrary to the statutes made and provided in such case."
