Facts:

- The accused appellants were charged with murder and frustrated homicide for the death of Milanes and the injury inflicted on SPO1 Cura.

- On January 10, 1995, while the victims and the accused were caught in a traffic jam, the accused Alexander and Ferdinand alighted from their tricycle and putted Milanes out of the jeepney. Alexander stabbed Milanes at the back, while Ferdinand held Milanes' neck under his arm. SPO1 Cura alighted from the jeep to pacify them.
