Qualifying Circumstance Treachery

Facts:

- On the night of Oct. 5, 1996, the victim and accused-appellant were engaged in a heated argument as to who among them would pay the bottles of beer they had consumed. The accused-appellant left then returned and approached the victim. He stabbed the victim several times then fled from the scene of the crime when the incident happened, prosecution witness Jocson was only 2 aims length from the victim and accused.

- During the trial the appellant pleaded not guilty to the crime of murder.

- Medico-legal findings showed that the stab wound located on the left breast was fatal.
