Facts:

- Philippine Consumers Foundation, Inc. (PCFI) filed, in 1982, a petition for specific Performance, Damages and Violation of PD551 (provides for the reduction of franchise tax paid by electric co. by 5 to 2 %) with the Board of Energy (BOE) docketed as BOE case No. 82918

- In 1980, a case of the same nature was also filed by PCFI. It was docketed 79-692. In this case the opinion of the Minister of Justice that it was mandatory for Meralco to return its retained investment to the ultimate consumers. This, however, was reversed by the Minister of Finance.
