This is a petition for review under Rule 45 of the Rules of Court seeking to set aside the October 20, 1992 Decision of the Court of Appeals[1] in CA-G.R. CV No. 27419, which affirmed with modification the Decision[2] of the Regional Trial Court of Mandaue, Branch 28, in Civil Case No. MAN-386.

The instant controversy stemmed from Lot No. 1242 (Lot No. 799-C) with an area of 1,853 square meters and located at Barrio Looc, Mandaue City.
