Facts:

- Accused-appellant was charged and convicted of statutory rape and sentenced to suffer the penalty of death.

- Accused countered that the charge was fabricated by his wife and that she is using their daughter to prevent him from digging further into her illicit love affair.

- Medical records also showed that there were no sighs of evident physical injury on the victim's body at the time of examination nor was there a hymeneal injury.
