Before us are two petitions for review on certiorari under Rule 45 of the Rules of Court, both filed by petitioner Pedro Aclon (Aclon for brevity). The first seeks to reverse and set aside the Decision of the Court of Appeals dated April 30, 1992 in C.A. G.R. CV No. 24106.[1] The second assails the Decision dated August 31, 1994 in C.A. G.R. CV No. 24133.[2]

The facts of the case are as follows:

On December 15, 1964, Aclon secured a loan from the Philippine National Bank (PNB for brevity)) at Catbalogan, Samar, in the amount of Five Thousand Pesos (P5,000.00), payable within one (1) year.[3]
