This case comes up on appeal from the Court of First Instance of the Province of Samar, where the accused, Frank E. Burns, was, on April 27, 1920, found guilty of the crime of arson and sentenced to twenty years of cadena temporal, with the accessories prescribed by raw, and adjudged to pay the costs.

At about 11 o'clock p. m., on the 5th of September, 1918, a fire broke out in the basement of the residence of Pedro de la Cruz in the municipality of Pambujan, Province of Samar.
