The facts underlying the present Petition for Review, as culled from the assailed Decision[1] of the Court of Appeals, are uncomplicated. Private respondent Reynaldo Cariño (Cariño) was hired in September of 1995 by petitioner Computer Innovations Center (CIC) as Instructor of Computer Technical Course.[2] He was promoted to Head of the Education Department of CIC in May of 1997.
