The Case 

Before the Court is a petition for review[2] assailing the Decision[3] of 21 December 2001 of the Court of Appeals in CA-G.R. CV No. 67794. The Court of Appeals reversed the Decision[4] of 11 May 2000 of the Regional Trial Court of Makati, Branch No. 139, in Civil Case No. 97-1379 denying respondents' prayer to partition the subject properties.
