It appears from evidence that during the period from October, 1919, to November, 1920, the defendant, Juan S. Canlas, was the agent of the plaintiff for the sale of merchandise in the Province of Pangasinan on a commission basis. On June 630, 1920, and accounting was had between the plaintiff and Canlas from which it resulted that the latter had failed to pay the plaintiff for merchandise of the value of P5,039.67. Canlas maintained that his failure to pay was due to the fact that he had sold some of the goods on credit and had been unable to collect the accounts from the customers, but the plaintiff...
