The Office of the Ombudsman filed the instant petition for review on certiorari assailing the Decision [1] dated October 30, 2003 of the Court of Appeals (CA) in CA-G.R. SP No. 69313, which had declared that the Office of the Ombudsman has no power to impose the penalty of suspension. According to the appellate court, its power is limited only to the recommendation of the penalty of removal, suspension, demotion, fine, censure, or prosecution of a public officer or employee found to be at fault.
