The events leading to these consolidated cases (a petition for review on certiorari[1] and a special civil action for certiorari[2] from a decision and a resolution of the Court of Appeals[3] [CA]) began with a game of golf.

On May 28, 2000, a Sunday, petitioners Ernesto Yu and Manuel Yuhico went to the Orchard Golf & Country Club to play a round of golf with another member of the club.
