As a defense, an alibi derives its strength from the fact that it involves the physical impossibility of the accused to commit the crime. Once established, it constitutes a complete, legitimate, and effective defense.[1]

This is a Petition for Review on Certiorari[2] under Rule 45 assailing the December 3, 2001 Decision[3] of the Court of Appeals (CA) and its September 5, 2002 Resolution[4] which denied petitioner's Motion for Reconsideration in CA-G.R.
